Sub: Sub delegation of powers to the Zonal Recovery Committee for recovery of arrears of H.T.Consumer.

Recovery Committee upto Division level are already functioning as per B.R.No.555 dtd.30.8.2002. The directive contained in the said B.R. were conveyed to field officers vide Ciruclar No.669 dtd. Sept. 6th ,2002.

The Board of Director of MSEDCLtd., resolved on date 8th Sept. 2005 vide item No.6, to accord approval to authorise the committee already functioning at Zonal Level as per B.R. No.555 dt.390.8.2002 to examine & decide on issues of recovery of arrears of HT consumers as mentioned below :

1. The Committee would comprise of the Chief Engineer of the concerned zone and the C.A.O./Jt.C.A.O. of the same zone as the two members.

2. The committee will have powers to decide on the following commercial matters.

a)To order reconnection of supply of disconnected H.T. Consumers whose arrears do not exceed Rs. 20 lakhs as on the date of order after accepting 30% or more as down payment of arrears. In case of LIS connections however the down payment shall be 25% or more of the arrears. In any case the amount of down payment should be more than the normal monthly consumption bill of the consumer.

b)To grant maximum of 2 installments of the balance arrears remaining after accepting down payment as per (a) above in case of commercial, residential, industrial & HT Consumers payable alongwith future current bills on due date of the bill. In case of HT LIS connections, the number of instalments shall not exceed 6. Postdated cheques are to be collected from the consumer for the instalments. Action as per law should be initiated against the consumer if the cheques are dishonoured.

c) While deciding on the number of installment the recovery committee shall have due consideration to the period of accumulation of arrears and the amount of energy bill which will indicate the paying capacity of the consumer.

d) No installment should be granted against current bill unless and until the supply is in disconnected status for more than 30 days..

The above reliefs shall be granted only after receipt of proposal, in line with the Circular No.708 dated 31.5.2004. H.T. cases where there is theft of energy, legal complications, and/or the arrears are disputed by the consumer, should not be dealt by the zonal level committee and

such cases should be dealt as per prevailing rules/MERC's orders or forwarded to the H.O. recovery committee as per the request of the consumer on receiving 2% or 5% payment as the case may be.

It is also resolved that the condition of insisting for post dated cheques is to be followed in all cases where such packages are granted.

All the recovery committees functioning as per B.R. No.555 dtd.30.8.2002 and all the concerned officers of MSEDCLtd., are directed to note the above resolution & act accordingly.
