New Service connection - verification of the Bonafides of the Occupancies.

Before releasing new senrlce connection to any premises, it is necessary to verify whether the applicant is a Lawful owner or occupier of the premises. Sincethe Field Officers encounter difficulties in practice for determining whether the applicant Is a Lawful occupier, enclosed are the guidelines as to who can be treated as lawful occupier which    has been reproduced from Barucha's Book known as I.E. Act 1910, 1967 Ed.

      It may however be noted that individual cases may be scrutinlsed thoroughly before releasing connection.

      Who is a Lawful Occupier? Since now the permission of the landlord for installing a connection is not necessary in practice cases of applicants for supply are encountered where the lawful occupation may not be so obvious, and electricity supply undertakings or suppliers need some criteria by which to be guided as to who may be safely considered as "LawfJ occupiers", so that on one hand they may not make a default, due to excessive precaution, in compliance of their statutory obligation to give supply to an applicant under Clause VI of the Schedule to the Act and on the other hand do not incurany liability as tresp asser by presuming an applicant to be a lawful occupier.
