Sub: Authorizing of MSEB officers to make written complaint for offences under Section 151 of the Electricity Act 2003..

            As per Board Resolution No.1144 dated 6.7.81 powers were delegated to the officers of the Board to institute criminal prosecutions against any person for any offence against provisions of the Indian Electricity Act of 1910 or any rules, license or order made thereunder to act as “ Aggrieved Person”  within the meaning of Section 50 of the Indian Electricity Act of 1910.

            The Electricity Act 2003 (36 of 2003) came into force with effect from 10.6.2003, repealing the Indian Electricity Act 1910 , the Electricity supply Act 1948 and the Electricity Regulatory Commission Act 1998.  As per Section 151 of The Electricity Act 2003, no court shall take cognizance of an offence punishable under this Act except upon a complaint in writing made by Appropriate Government or Appropriate Commission or any of their officer authorized by them or a Chief Electrical Inspector or an Electrical Inspector or Licensee or the Generating Company, as the case may be, for this purpose.  The Maharashtra State Electricity  Board, being a Licensee, has, therefore, delegated powers vide Board Resolution No.1163 dated 8..1.2004 under Section 151  of the Electricity act 2003 to the  Officers as per the statement below:
